Note

NIE, TIE and residencia compared

By Inés Arroyo VidalReviewed by Marta Calderón IbáñezPublished Updated Stage 4: Check and contract

Quick answer

The NIE is an identity number. The TIE is the card given to people authorised to stay in Spain for more than six months, and it shows the type of authorisation. Residence is the permission itself. A buyer needs the number, not the card, and owning a home does not by itself create a right to stay.

Applies toBuyers confused by the three terms, and owners who are wondering whether the number gives them a right to stay.

§ 1Three words, three things

People use NIE, TIE and residencia as if they meant the same. They do not. The NIE is a number, the TIE is a card, and residencia is a legal status. Understanding the difference saves you from asking an office for the wrong thing and from relying on a document that does not prove what you think it proves. The full explanation of the number is in the NIE explained.

§ 2The NIE

The NIE, número de identidad de extranjero, is a personal, unique and exclusive number. The official page says it must appear on documents issued or processed for a foreigner. It is given to people with economic, professional, social or other ties to Spain, and it comes automatically with a visa for stays longer than ninety days in any period of one hundred and eighty. It is an identity and tax reference. It does not authorise anyone to live in Spain.

§ 3The TIE

The TIE, tarjeta de identidad de extranjero, is the physical card. The ministry’s page says that people granted a visa or an authorisation to stay in Spain for more than six months receive a single document, the TIE, which states the type of authorisation. A person who has the card has a right to stay of the kind shown on it. A buyer who lives abroad and visits Spain as a tourist has no card.

§ 4Residencia

Residencia means being authorised to live in Spain, and it comes in several kinds. Citizens of other EU states register in Spain instead of receiving a visa. Citizens of other countries need an authorisation of one kind or another. The section on residency of this handbook explains the routes, and the answer for a buyer is that the purchase itself does not create residence. For the tax meaning of residence, which is different, see the section on tax residence.

§ 5Which one a buyer needs

For the purchase you need the NIE. You do not need the TIE or residence. A buyer who is also moving to Spain will need a residence route, and the card follows. In the meantime the paper certificate of the number is enough for the notary, the registry, the tax office and the bank.

§ 6Common confusions

Some banks ask for “your TIE” when they mean any identification with the number. If you are a non-resident, explain that you have the NIE certificate and your passport, and ask what else they need. Some websites offer “a NIE card”, which does not exist: the number is on a paper certificate. And the number on your certificate and on a future TIE is the same.

§ 7Keep the paperwork

Keep the certificate of the number with your deed and your tax papers. If you lose it, a lawyer can request a copy. The way to obtain the number is explained in how how to get a NIE works, and the reasons a purchase needs it are in how a NIE for buying property works.

The appointment is covered in how the NIE appointment works.

FAQRelated questions

Do I get a TIE if I buy a home?

Not from buying alone. The card goes to people with permission to stay beyond six months, whereas a purchase only needs the number. For a residence route, speak to a lawyer about visas.

Is the NIE enough to open a bank account?

Usually yes for a non-resident account, together with your passport, though banks set their own rules. A resident account may require proof of address. Ask the bank which documents it wants before you travel.

Does the number change if I become a resident?

No. The number is personal and unique and stays the same. If you later receive a residence authorisation, the TIE card will carry the same number, and you should update your details with the bank and the tax office.
