Why you need a NIE to buy property in Spain

By Inés Arroyo VidalReviewed by Marta Calderón IbáñezPublished Updated Stage 4: Check and contract

Quick answer

The notary, the tax office, the registry and the bank all identify foreigners by their NIE, so you need it before the deed and usually before a reservation is practical. Apply as soon as you have chosen an area, and ask your lawyer which documents will show the tie to Spain.

Applies toBuyers who are planning a purchase and wondering when to apply. It does not cover residence permissions.

§ 1Where the number is used

A purchase touches four institutions, and each asks for the number. The notary records it in the deed because the law requires the parties to be identified. The tax office uses it to register the return for the transfer tax or stamp duty. The land registry uses it to record you as the owner. The bank uses it to open the account from which the price is paid, and a lender asks for it before it will process a mortgage application. The full explanation is in the chapter on the NIE.

§ 2The timing problem

The number is rarely the hardest part of a purchase, but it is the one most often forgotten. A buyer who finds a home, signs a reservation and then discovers that the number takes weeks may lose time or money. The best habit is to apply when you decide where to buy, not when you find the home. If you have already signed a reservation, apply at once and tell your lawyer.

§ 3What the office wants to see

The official page asks for a statement of the economic, professional, social or other reasons for the request. For a buyer the reason is the purchase. A reservation contract, a letter from the agent or lawyer, or a pre-approval from a lender can help show that the tie is real. Without a document, a plain explanation in the form is usually enough, though a consulate may ask for more.

§ 4Representatives and power of attorney

Many foreign buyers never visit an office. They give their lawyer a power of attorney to apply on their behalf. The official page says the power must expressly authorise the representative to file the request, so the wording matters. The lawyer or the notary will draft it. The steps for the application are in more on how to get a NIE.

§ 5Contracts and the number

Check the reservation contract and the private purchase contract for a date by which you must provide the number. If the date is short, ask for it to be extended or tied to a reasonable event, such as five working days after the office issues the certificate. Never agree to lose a deposit because an office was slow.

§ 6Joint buyers and companies

Each person named in the deed needs an identity number. A company that buys has a tax number of its own. A buyer who is an individual and who uses a company must understand that the company also needs a number and that the director’s number is required for filings. Ask your lawyer which structure is simplest for your case.

§ 7A short plan

Decide where you will buy. Choose how you will apply. Gather your passport and the documents for the request. Pay the fee. File. Ask the lawyer to follow the file. When you have the certificate, send copies to the notary and the bank. The appointment problem has its own page, the NIE appointment explained, and the difference between the number and the card is explained in the difference between NIE and TIE explained.

FAQRelated questions

Can I sign a reservation without a NIE?

You can often sign a reservation, but you cannot complete the purchase. Check what the contract says about the date by which you must have the number, and avoid a clause that makes you lose your deposit if the office is slow.

Does my NIE expire?

The number is personal and unique and stays with you. A paper certificate may be asked to be recent by some offices, so ask your lawyer whether the notary or the bank wants a fresh copy before signing.

Do both spouses need one?

Each buyer who will be named in the deed needs a number of their own, since the number identifies a person. If one spouse buys alone, only that spouse needs it for the deed, but ask your lawyer about the marriage regime first.
