Spain short-term rental registry number: annulled in 2026

By Inés Arroyo VidalReviewed by Marta Calderón IbáñezPublished Updated Stage 6: Rent out

Quick answer

The Supreme Court annulled the provisions of Royal Decree 1312/2024 that created a single national procedure for a short-term rental registry number, in a judgment of 19 May 2026 published in the gazette on 8 June 2026. Regional registers and regional rules remain. We read the operative part of the judgment, not its reasoning, and cannot say how numbers already issued are treated.

Applies toOwners who let or plan to let a Spanish home for short stays, and buyers of a home that is let that way.

What changed
  • The Supreme Court annulled the national registry number procedure on 19 May 2026, published on 8 June 2026. The page now explains what the decree did, what the court removed and what remains. Source: s-sc1312

§ 1What changed

This page belongs to the chapter on Holiday rental licence Spain. Royal Decree 1312/2024, of 23 December, created a single national procedure to register short-term rentals and obtain a registry number, with a digital one-stop window for data on those rentals. In a judgment of 19 May 2026, published in the gazette on 8 June 2026, the Supreme Court (third chamber) partly upheld an appeal by the Generalitat Valenciana. It annulled the provisions of the decree on the single registry procedure and dismissed the appeal on every other point. Costs went to nobody.

We read the operative part of the judgment in the gazette. It names the articles removed: the first article as far as it covers the single procedure, parts of the second, the fifth to the tenth articles in the parts that concern the procedure, part of the twelfth, the second additional provision and the part of the first final provision that gave the State its competence for it. We did not read the court’s reasoning. Press reports say the court found that the State lacks competence for a national register that overlaps the regional ones. That is press, not the judgment text.

§ 2What the decree set up

The decree said the procedure began with an owner’s request, filed on the electronic site of the Colegio de Registradores or on paper at the competent registry, and handled by the Property Registry. For each unit the request had to give the address, the unique registry code and the cadastral reference. In a case published in the gazette in January 2026, the Directorate-General for Legal Security and Public Faith (DGSJFP) explained that registrars were to check planning, administrative and certain civil requirements, including obstacles under the horizontal property law. Those cases were decided before the judgment, so read them as history of how the procedure worked, not as a rule in force.

§ 3What stays

The judgment is not a licence to let. Regional authorisation or registration, municipal licences and the rules of each region still apply, and the pages for the Valencian Community, Andalusia, Catalonia, the Balearic Islands, the Canary Islands and Madrid describe them. The EU rules on data from short-term rental platforms are not what the court annulled either: press reports that the digital one-stop window and the platforms’ duty to send data survive, and that most regions keep their own registers. We could not confirm from an official source from which day the annulment takes effect, how the ministry or the registrars now treat requests already filed, or what platforms do with numbers already issued.

§ 4The community’s approval is a separate rule

Since 3 April 2025 a new tourist let in a building under the horizontal property law needs the community’s prior express approval. Two DGSJFP resolutions published in the gazette on 9 July 2026 apply that rule: a “tourist” label in the title deed, or statutes that favour tourist use, do not count as express approval, and the exception for owners already letting before that date is narrow. These resolutions stand apart from the annulled registry procedure. The community vote explained covers the rule and the vote.

§ 5A case from Madrid

Before the judgment, a Madrid registrar refused a number because the owner had only a regional registration from 2018 and no municipal licence, and the Directorate-General dismissed the appeal. The case shows that a regional registration and a municipal licence are separate papers. That point is about Madrid’s own rules, which Madrid explained describes, and not about the annulled number.

§ 6Before you rely on a number

If you hold a number, keep the papers behind it. If you buy a home that is let to tourists, ask the seller for the regional registration, the municipal licence or declaration and the community’s approval, and ask your lawyer which number the platform currently asks for. Ask for the answer in writing.

§ 7What we did not read

We did not read the court’s reasoning, the decree beyond its first and part of its ninth article, the effect on numbers already issued, or the platforms’ current practice. Ask your lawyer for the current position.

§ 8More on this topic

More on letting on Airbnb explains the platform side of tourist lets and the Valencian Community explained explains the Valencian rules for tourist dwellings.

Andalusia explained explains what the Junta says about tourist dwellings and Catalonia explained explains the Catalan decree-law on tourist dwellings.

The Balearic Islands explained explains the Balearic decree-law on tourist stays in dwellings.

FAQRelated questions

Do I still need the national registry number?

Not on the strength of Royal Decree 1312/2024, because the Supreme Court annulled the provisions that created it. Regional registration and licences still apply, and platforms still send data to the authorities. Ask a lawyer registered in your region which number your platform asks for.

What happens to a number I already have?

We could not confirm it. The operative part of the judgment does not say, and we did not read the reasoning. Keep the number and the papers behind it until your lawyer or the registry says otherwise.

Why does the ruling matter if I am buying a home that is let?

An advert may still quote a national number that no longer stands for a national check. Ask what papers sit behind it, and who confirmed them.
