Source of funds when buying property in Spain

By Inés Arroyo VidalReviewed by Marta Calderón IbáñezPublished Updated Stage 2: Budget and money

Quick answer

The source of funds is the explanation of how you came to hold the money, supported by documents. We found no official list of accepted documents. Match each source to evidence: a sale deed, a will, payslips, tax returns or statements, and keep the trail to the account that pays.

Applies toBuyers who are asked to explain the origin of the money they will use.

§ 1The question

Anti-money-laundering rules oblige banks, notaries and agents to understand where a buyer’s money comes from. The answer is a story with documents: I earned it, I sold something, I inherited it, I was given it. The documents turn the story into evidence. This page belongs to the chapter in paying without a mortgage in detail.

§ 2Salary and business income

Show tax returns, payslips or accounts, and the bank statements where the income arrived. A person who has saved over years can show statements over a period. Large jumps in the balance should be explained.

§ 3A sale

If the money comes from selling a home, a business or shares, show the sale contract or deed, proof that the price was paid, and the account where it arrived. If tax was paid, show that too. The costs section explains the Spanish taxes on selling property in Spain, and a sale elsewhere follows that country’s rules.

§ 4An inheritance

Show the will or the document that confers the inheritance, the probate or equivalent, and the account that received the money. The legal process section explains inheritance in Spain, and an inheritance abroad follows that country’s rules.

§ 5A gift

A gift needs a record: a statement from the donor that the money is a gift, the donor’s identity, and, where requested, the donor’s evidence of source. Rules on gifts and tax differ by place. Ask an adviser before you rely on a large gift.

§ 6Investments and savings products

Show statements for the account or product, with the dates and amounts, and the transfer to your bank account. If you sold investments, show the sale confirmation.

§ 7Companies

If the funds come from a company, show why the company is paying you or buying: a dividend resolution, a loan agreement or a sale. A payment from a company without a clear reason raises questions.

§ 8Organising it

Put a one-page summary on top, with each source, amount and date, followed by the documents in the same order. Send it to your lawyer first, and let the lawyer decide what goes to the bank and the notary. Proof of funds explained explains proof of funds, and anti-money-laundering rules explained explains the rules.

§ 9When something is missing

If a document is missing, say so at once and offer what you have: a bank record of the sale, a letter from the former employer or an accountant’s statement. Your lawyer can advise whether it is enough. Never alter or invent a document.

§ 10Translations

Documents in another language may need a translation, sometimes a sworn one. Ask who will accept what. Write down the question, the answer and the date, and keep the reply with your purchase file. Ask your lawyer to read anything that affects the amount or the timing, and do not rely on a verbal promise. If two sources disagree, ask for the official text and tell the person in writing which version you are relying on.

How cash payment limits work explains the limits on cash payments.

FAQRelated questions

What documents show the source?

It depends on the source: a sale contract for property sold, a will or grant of probate for an inheritance, payslips or tax returns for earnings, a gift letter and the donor’s records for a gift. Ask the party asking what they accept.

What if the money comes from several places?

Keep a short summary page that lists each source and amount and points to the evidence. A clear summary helps the bank and the notary, and helps your lawyer answer questions quickly.

What if I cannot document some of it?

Say so early to your lawyer. Undocumented money is a risk for you and for the professionals. Gather what you can, and ask the lawyer whether the money can be moved through a regular route before the deed.
