§ 1The rule

The Tax Agency states that article 7 of Law 7/2012, as amended by Law 11/2021, lowered the general limit on cash payments to €1,000. For private individuals with tax domicile outside Spain, the limit was lowered to €10,000. Earlier limits were higher. This page belongs to the chapter in an overview of paying without a mortgage.

§ 2Who it applies to

The rule covers operations in which one party acts in a business or professional capacity. Payments between private individuals are outside it, and so are payments and deposits made to credit institutions. So the rule matters when you buy from a developer, an agent or another business, and when you pay a professional.

§ 3Splitting payments

The text we read does not address the splitting of a single operation into several payments. Do not assume that splitting works. The anti-money-laundering catalogue lists requests to split payments over short periods as a risk indicator, as how anti-money-laundering rules work explains. A split intended to avoid a limit is a red flag.

§ 4Fines

The Tax Agency says that breaches follow the ordinary rules on sanctions and that the agency runs the procedure across Spain, including the Basque Country and Navarre. We did not find the amounts of fines in the text, and we do not state them.

§ 5Property in practice

A home purchase of any size is paid through the banking system. The notary records the means of payment, and a payment that leaves no trace would raise questions at the notary, the bank and the registry. Even where a cash payment would be lawful between two private individuals, it is a poor idea, because it leaves no evidence for you.

§ 6The deposit

A small deposit to an agent or a developer is a payment to a business. Pay it by transfer and ask for a receipt. The legal process section explains reservations and deposits, and how to make sure the deposit is protected.

§ 7Currency

The limit is in euros. Cash in other currencies is converted for the purpose, so do not use currency to get around it.

§ 8Advice

Ask your lawyer to arrange the payments so that all of them are traceable. See Source of funds Spain property for the documents that explain the money.

§ 9Records

Keep the receipt for every payment, the transfer confirmation and the invoice. If a professional asks you to pay in cash, ask for the reason in writing, and consult your lawyer before you pay.

§ 10Ask in writing

Ask any seller, developer or agent how they want to be paid and request the payment details in writing. Write down the question, the answer and the date, and keep the reply with your purchase file. Ask your lawyer to read anything that affects the amount or the timing, and do not rely on a verbal promise. If two sources disagree, ask for the official text and tell the person in writing which version you are relying on.

FAQRelated questions

Can I pay for a house in cash?

Not in practice. The limits bite when a business or professional is on one side, and big sums travel through banks anyway. Settle the price by transfer from an account held in your own name.

Does the higher limit apply to me?

It applies to private individuals whose tax domicile is outside Spain, and only to transactions within the scope of the rule. It does not make large cash payments for a home sensible, since the notary records how the price was paid.

What happens if the limit is exceeded?

The Tax Agency says breaches fall under the ordinary sanctioning rules, and that it runs the procedure nationwide. We did not find fine amounts in the text we read, so ask your adviser.
