Note
Register a property in Spain: registro de la propiedad
Quick answer
After the deed you pay the purchase taxes and present the deed to the land registry. The registry waits for proof that the taxes have been settled. Registration makes you the recognised owner against the seller’s creditors and hidden charges. A gestor or lawyer usually does the filing.
Applies toBuyers who have signed the deed and want to complete the process properly.

§ 1What registration is
The land registry records the ownership of property and the rights and charges affecting it. When you buy, your deed is presented to the registry, which examines it and records you as the owner. The registrars say this makes the buyer the recognised owner against the seller’s creditors and hidden charges. It is the last step of the process and one of the most important. It belongs with the chapter in an overview of completion and the deed.
§ 2The order of steps
The registrars list the steps as: find the home, sign the contract, pay taxes, register, understand the costs. The taxes on the purchase must be paid before the registry will register the deed. The deadline is set by the region, and the usual period is 30 working days. A delay in the tax delays the registration. The role of the gestor in this sequence is explained in the chapter on professionals.
§ 3Who files
The notary can file the deed with the registry on request. Often the gestor or lawyer does it, after the taxes are paid. Ask who will file, on what date, and how you will receive the proof. Ask for the registry’s entry number and date of presentation. The presentation gives priority from that date.
§ 4The registrar’s examination
The registrar checks that the deed is valid, that the seller was the registered owner and that no conflicting entry exists. If there is a defect, the registrar issues a note and gives a period to correct it. The most common problems are mismatches in the description, missing tax proof and doubts about the powers of a representative. Prompt correction avoids delay.
§ 5What you receive
When the registration is done, you receive proof of the registration, and you can ask for a registry extract showing yourself as the owner. Keep it with the deed. Order the extract and compare it with the deed, because an error is easier to fix early.
§ 6After registration
Update the cadastre if needed, check the property tax holder, and keep the documents. If there was a mortgage, confirm that its cancellation was also registered. The costs of registration follow the state scale, and what the registry charges for registration sets out the amounts.
§ 7Checking the result
When the registration is complete, read the entry carefully. Check your name and identity number, the share, the description of the property and the price or title. Check that the charges listed are the ones you expected, and that the seller’s mortgage has been cancelled. If you find an error, tell your lawyer straight away.
§ 8If you do nothing
Without registration you remain exposed. The seller’s creditors may still obtain charges against the property, and you may be unable to sell or mortgage it. The cost of registration is small compared with these risks. The practical steps for the day itself are in completion day explained.
§ 9More on this topic
Power of attorney explained explains how to buy through an attorney and how signing from abroad works explains how to sign the purchase without being in Spain.
FAQRelated questions
Is registration compulsory?
Not to complete the sale between you and the seller, but skipping it leaves you exposed to third parties who rely on the register. Treat it as essential, and ask for proof of filing.
How long does it take?
The time varies by registry and workload, and it depends on the taxes being paid first. Ask your gestor or lawyer for an estimate and for proof of the filing date, which gives you priority from that date.
What if the registry finds a defect?
The registrar can issue a note listing the defects and giving a period to correct them. Your lawyer or gestor should respond promptly. Delays in correcting can lose time, so tell them where to send the notes.
