Note
Spain restrictions on non-resident property buyers
Quick answer
We found no national law that bars non-residents from buying a home in Spain. Defence-zone rules apply to non-EU buyers, taxes differ by residence, and proposals such as bill 122/000196 are not law. Confirm the status of any rule in the official gazette.
Applies toNon-resident buyers who want to know what actually limits them.

What changed
- Added the stressed-zone resolution of July 2026; still no restriction on non-resident buyers in force. Source: s-stress-jul
§ 1The starting point
Spain does not have a general rule that stops foreigners or non-residents from buying homes. Foreigners buy through the same deed, notary and register as Spaniards. What differs is a small set of rules that apply to some buyers in some places, and a larger set of proposals. This page belongs to the chapter in rules and policy explained.
§ 2Defence zones
Property near defence installations, borders and parts of the coast is subject to military authorisation for buyers who are not EU nationals. The by-nationality section explains who is affected and how to check. This is a long-standing rule and not a recent restriction. Citizens of EU states are outside it.
§ 3Tax differences
Taxes depend on the residence of the owner and not only on the property. A non-resident owner files returns for the home, and the rate on property income differs between residents of the EU and EEA and of other countries. The costs section explains them. These differences are not restrictions on buying.
§ 4Housing law
The housing law of 2023 concerns rents, large holders and vacant homes, and lets regions declare stressed zones. It does not restrict purchases by non-residents. The resolutions of April 2026 and of 24 July 2026 that list new stressed zones say nothing about purchases.
§ 5Proposals
The proposals that would affect non-residents are of three kinds: a state tax on transfers to non-EU residents, which is bill 122/000196, a Balearic debate on allowing limits, and a Canarian request to the EU and to the Spanish government. None had become law in the sources we read.
More on the 100 percent tax proposal explains the tax, and more on the Balearic Islands the Balearic position.
More on the Canary Islands explains the Canarian request.
§ 6What to ask
Ask your lawyer to confirm in writing that no rule restricts your purchase in the town and for your nationality, that no authorisation is needed or has been obtained, and that no pending text has a date that affects your timeline. A good lawyer will do this as part of the checks in the legal process section.
§ 7If something changes
If a rule is adopted after you sign a reservation, the contract determines your position. Conditions in the contract, such as a clause tied to authorisation, protect you. The legal process section explains reservations and private contracts.
§ 8Dates
This page records the sources we read, with their dates. The rules chapter logs changes as they occur.
§ 9Residents and non-residents
Many rules distinguish residents from non-residents for tax, for lending and for services. Becoming a resident changes the tax regime, and the residency section explains the tests. It does not change the right to buy.
§ 10More on this topic
More on law changes in 2026 explains what changed in 2026 and what we could not verify and more on tax changes for non-residents explains tax rules for non-residents and what is still a proposal.
FAQRelated questions
Is there a ban on non-residents buying?
Not at national level, in the sources we read. There is a defence-zone authorisation rule for non-EU buyers, differences in tax by residence, and proposals that are not law. Confirm the position with a lawyer for your area.
Do islands have their own restrictions?
We found requests and proposals about the Balearic and the Canary Islands, but no restriction in force in the sources we read. The island pages explain what we found and what we could not confirm.
What should I ask my lawyer?
Ask whether any rule restricts your purchase in this town and for your nationality, whether authorisation is needed, and whether a pending proposal could affect the timing. Ask for the answer in writing with the gazette references.
